DEPOSITS & PAYMENTS To reserve the time and date of services, please accept the terms and conditions and arrange payment of a non-refundable, non-transferable reservation deposit of €250.
No date can be reserved until the T&C's are accepted and deposit are received. The balance due for the videography services must be paid in full on the event date.
CHANGE OF DATE OR VENUE Please notify the Videographer immediately of any changes in schedule or location. Notification of any changes can be made by phone along with written notice sent via email for documentation. It is the client’s responsibility to confirm all arrangements with The Videographer at least 7 days prior to the event. In the event of change of address or contact information as listed, please remember to notify The Videographer.
CANCELLATION If the event is cancelled within 30 days of the wedding date, Client shall be required to pay the full balance due. Once a balance is paid, it is non-refundable. Cancellation must be in email/writing even if a phone call was made to inform The Videographer of the cancellation. Client is hereby strongly advised to take out a Wedding insurance policy to cover all expenses in the event of a cancellation. For example, a family member may take ill at the last moment and you may feel you need to postpone. There are several companies in Ireland now offering this. Please search online for info.
RESCHEDULING In the event that The Client reschedules the wedding and The Videographer is able to rebook the original wedding date, The Client will receive credit for all monies already paid. A new contract may be required. The new package price will reflect pricing in effect when the date change occurs.
In the event that Client reschedules the wedding and the Videographer is not able to rebook the original wedding date, Client forfeits the deposit but will receive a credit for all other monies paid. Credit may be applied to wedding coverage only within one year of original date provided Videographer is available.
COOPERATION: The Client agrees to set time before the ceremony commencement of the wedding, and after the ceremony for photographs. If The Client’s late arrival prevents this from occurring The Videographer cannot be held liable for failure to take desired footage. The Client and The Videographer agree that cheerful cooperation and punctuality are therefore essential to that purpose. Shooting commences at the scheduled start time.
FAILURE TO PERFORM Due to the limited and subjective nature of the event, The Videographer cannot be held responsible for any lost filming opportunities due to other cameras or flashes, the lateness of the bride, groom, or other principles. The Videographer cannot be held responsible for the lack of coverage due to weather conditions, scheduling complications, rules and restrictions regarding the taking of footage at the church or venue. The Videographer will do his very best to fulfil all requests but can make no guarantees that any particular footage will be delivered. Clients are responsible for any location fees and permits.
COVERAGE The Videographer shall be granted full artistic license in relation to the poses filmed and the locations used, although every effort will be made to comply with the Client’s requirements. The Videographer shall endeavour to capture all the moments throughout the day as they occur. However, because of the fluid nature of the event, some moments might not be recorded, or not recorded for logistical or technical reasons. For a booking involving a church ceremony or at certain venues, the priest, minister, or hotel manager sometimes restricts the Videographer’s movements.
Every effort will be made to record the best possible picture and sound quality, however frequency interference may cause distortion to wireless microphone sound in certain locations. The videographer will monitor the sound and picture quality at all times however if during a crucial ceremony time there is a loss of sound or picture quality the videographer will not be held responsible for this technical error. For example a hotel may not agree to use a wireless microphone, which will impact on the final audio quality. It is the responsibility of the client to notify the priest and hotel that the videographer intends on using wireless microphones and will make every effort not to interfere with the church and hotel P.A systems.
The area from which the Videographer is able to work may not be The Videographers choice, and The Videographer cannot accept responsibility for any obstructed view should this be the case. The use of artificial lighting may also be restricted or prohibited. In addition, The Videographer is not responsible if key individuals fail to appear or cooperate during photography sessions, or for missed images due to details not revealed to The Videographer in advance. Extreme low lighting will not work in favour of videography coverage. Every effort will be made to work with lighting conditions but low light at a hotel or church will result in grainy footage and this is not the responsibility of the videographer.
FORCE MAJEURE If The Videographer is unable to perform any or all of the duties herein for any reason, including but not limited to, fire, casualty, strike or other civil disturbances, Acts of God, road closures, severe traffic, terrorism, poor weather conditions or other causes beyond the control of the parties then The Videographer shall return any moneys paid by the client but shall have no further liability with respect to the agreement. This limitation of liability shall also apply in the event that footage materials are damaged in processing, lost through camera or card malfunction, lost in the mail, or otherwise lost or damaged without the fault on the part of The Videographer. Liability for a partial loss of video footage shall be pro-rated based on the percentage of total. The sole remedy for any actions or claims shall be limited to a refund whose total amount does not exceed the total monies paid by Client under this Agreement during the time preceding the date on which such liability arises.
COPYRIGHT The copyright of all footage created by The Videographer remains the copyright of The Videographer. It is illegal under Irish copyright law to copy, scan, or allow additional copies to be created, published, reprinted, duplicated, digitally reproduced, or altered (digitally or otherwise), without The Videographer’s express written permission. Final videos can be copied for the purpose of storage without permission of The Videographer. Client further agrees not to supply images to any third parties (including any vendors associated with the wedding industry) unless permission is granted first.
PRICING Services or merchandise not included in this initial contract will be sold at current price when an order is placed. All prices are subject to change at any time without notice. Credit vouchers have no intrinsic cash value and may only be applied toward merchandise purchased from The Videographer
RESPONSIBILITIES Unless agreed upon in advance, Thady Kavanagh or one of the videography team shall be the exclusive videographers retained for the event. The Videographer may bring one assistant at his discretion. Wedding guests may take photos, but it is the responsibility of The Client to prevent family and friends from interfering with The Videographers duties. The Videographer cannot be held responsible for compromised coverage due to causes beyond his control such as other people's camera or flash. The Videographer cannot be held responsible for existing backgrounds or lighting conditions, which may negatively impact or restrict the Videographer coverage.
EXTRA COVERAGE The Videographer will provide coverage for the dates, locations and continuous hours specified in this Agreement. Additional travel or coverage hours may be added only by prior agreement with The Videographer. The Videographer may not be available to work extra hours on the wedding day due to other commitments if this has not been arranged well in advance.
MODEL RELEASE Unless directly specified through written or email communication by the client this contract also serves as a model release giving the Videographer the right to use the footage in all forms and in all media and in all manners, without any restriction as to changes or alterations, for competitions, advertising, trade, promotion, exhibition, professional samples, displays, internet website pages, social media outlets or any other lawful purposes. The Videographer can grant use of the images to third parties such as venues, florists etc and all compensation for use and credit for the images remain the property of The Videographer. Client waives any right to inspect or approve the footage, or the use to which it may be applied, including written copy that may be created and appear in connection therewith. This release is binding on the Client, their legal representatives, heirs, and assigns. If the client specifies that they do not wish their images used for promotional purposes it their responsibility to inform the videographer of this request preferably before the wedding date. In this case the utmost client confidentiality will be adhered to and no images will be used in the public or commercial domain.
EVENT FOOD SERVICE A meal is required for events over 6 hours for The Videographer. This normally involves a bar menu meal in the hotel.
CREATIVE LICENSE Footage is edited at the videographer’s discretion. The videographer reserves the creative right to edit and release only those images deemed creditable as professional in quality and within the videographer’s artistic standards. Images determined by the videographer to be substandard or duplicated will be edited out. The videographer will use his professional judgement and sole discretion to select which shots to edit. Such selection shall constitute all images that will be made available to The Client.
VIDEO DELIVERY TIMES: Master Video delivery is 12-16 weeks from the date of the wedding.
SUBSTITUTION: In the event of illness or sudden event out of the control of both parties, The Videographer will attempt to substitute a qualified videographer at no cost to client. In the event no substitute can be found then all money will be returned to the client with no further liability to the Videographer.
MEDIA STORAGE: The videographer does not permanently archive any of the media affiliated with a wedding. Footage is usually stored for up to 24 months.
The Videographer recommends you back up your videos once you have received them either on hard drive or using a cloud-based service. Once the client has received the files then handling and storage of the video files is the responsibility of the client.
The undersigned hereby acknowledge that they have received, read, and understand The Videographers's current price list. Only the bride and groom (or signers of this document) can discuss any problems that arise.
